OFFICIAL RULES: Westways® Photo Contest XI
Some aspects of these rules differ from previous contests. Please read them carefully.
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING.
1. ELIGIBILITY
Entrants (each, an “Entrant”) must be legal residents of California who are 18 years of age or older as of the date of entry, and members* in good standing of the Automobile Club of Southern California, 3333 Fairview Road, Costa Mesa CA 92626-1698 (“Auto Club” or “Sponsor”), prior to January 10, 2025, to enter Westways Photo Contest XI (“the Contest”).
Entry in the Contest does not constitute entry into any other promotion, contest, or sweepstakes. By participating in the Contest, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules (the “Official Rules”) and the decisions of Sponsor, which shall be final and binding in all respects.
* Note: The photographer must possess his or her own 16-digit AAA membership number, meaning that he or she is either a primary, associate, or dependent (subject to the age restriction above) member. Membership numbers of potential winning entries are checked: Entries with membership numbers that do not match the name of the photographer will be ineligible.
Employees of the Auto Club and its affiliated clubs, affiliates, subsidiaries, and related companies, participating promotional vendors (and their affiliates, subsidiaries, and related companies), and service providers and their respective immediate families (as well as household members of each, whether related or not) (together, the “Promotion Entities”), are ineligible. The Contest is open to both amateur and professional photographers. Void outside of California and wherever prohibited by law.
2. CONTEST DEADLINE
The Contest commences at 12:01 p.m. PST, January 24, 2025, and ends at 11:59 p.m. PDT, May 12, 2025. Sponsor’s computer is the official timekeeping device for the Contest. Winning entries will be published in the Winter 2025 issue of Westways magazine.
3. ENTRY
By following the submission guidelines in Section 4 below, submit one digital image of natural beauty photographed by Entrant from anywhere in the world. Subject to the rules below, this could include landscapes, wildlife, and/or other unique scenes. Limit one entry per household.
The competition is open to original, unpublished work photographed by Entrant on or after August 1, 2023.
Attention: A photo is ineligible if …
• it is generated using artificial intelligence.
• it is made by using drone-mounted equipment.
• it requires the use of a model release for identifiable people or any other type of release for any copyrighted subject owned by others (as determined by Sponsor in its sole discretion).
By entering this Contest, you agree to abide by its rules and to accept the judges’ decision as final. By entering this Contest, you also warrant and represent to Sponsor that your entry: (a) is your original work; (b) has not been previously published or produced; (c) has not won previous awards; (d) as of the date of submission, is not the subject of any actual or threatened litigation or claim; (e) does not and will not violate any applicable laws, and is not and will not be defamatory or libelous; and (f) does not infringe upon the copyrights, trademarks, rights of privacy, publicity, or other intellectual property or other rights of any person or entity, including as a result of publication of your entry via various media including print and web posting, and you will indemnify, defend, and hold harmless the Sponsor from any claims to the contrary. Each Entrant hereby agrees to indemnify and hold the Promotion Entities harmless from and against any and all third-party claims, actions, or proceedings of any kind and from any and all damages, liabilities, costs, and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations, or agreements of Entrant hereunder.
By entering this Contest, you understand and agree that you may be required to authenticate your entry as your own original work, using a method to be determined by Sponsor in its sole discretion, in the time frame provided upon Sponsor’s written request (generally within seven calendar days from the date of such a request). Such methods include, but are not limited to, the provision of metadata; the original image, slide, or negative; and/or answers to such questions as how you set up the shot.
In addition, by entering this Contest, you understand and agree that submission of any entry that violates any of the above representations and warranties may result in forfeiture of an awarded prize and cancellation of Entrant’s Auto Club membership.
You further agree, and represent and warrant to Sponsor, that your entry meets these standards of photo manipulation: This Contest accepts color and monochrome digital images that have been created by Entrant with any device, including smartphones and still cameras (including medium- and large-format cameras). Images may be from single capture or stitching software, film, or digital capture, but must be 100% photographic in origin. Images that have been retouched by Entrant using software, a camera app, a photo-editing app, or by other means will be accepted, but excessive manipulation may be scored down by the judges. Computer-generated images and elements are not permitted.
Rule of thumb: While digital manipulation is permissible, it should be limited to cropping; minor adjustments to color, white balance, tone, lighting levels and curves, shadows and highlights, saturation, contrast, and/or sharpness; moderate dodging and burning; removal of dust spots; and moderate reduction of image noise. Photo editing tools should not be used to remove, add, or rearrange elements. Any changes to the original photograph not itemized here beyond what is necessary to conform to the required file guidelines for entry will render the photograph ineligible for a prize.
Submission of an entry grants Auto Club and third parties authorized by Sponsor and its affiliates, and their respective successors and assigns, the perpetual right to publish, use, perform, display, distribute, edit, adapt, modify, excerpt, copy, and otherwise use the entry for any and all purposes in any and all media currently in existence or hereafter developed without compensation to Entrant, which includes, but is not limited to, the right to publish the entry in Westways magazine, on AAA.com (including any other related websites and social media platforms), and to use the entry as Sponsor sees fit in exhibitions and promotions of Westways magazine. Entrant also agrees to sign all additional documents respecting the entry requested by Sponsor, including any further permission or license, in order for Sponsor to use the entry as contemplated in these Official Rules. (This paragraph updated February 28, 2025 to remove the term "exclusive.")
Submissions may not:
• Contain material that violates or infringes another’s rights, including but not limited to privacy, publicity, or intellectual property rights;
• Contain material that is violent, inappropriate, depicts nudity, or is indecent, obscene, hateful, tortious, defamatory, slanderous, or libelous;
• Contain material that promotes bigotry, racism, hatred, or harm against any group or individual, or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age;
• Contain material that promotes any illegal activities or any other activity that may appear unsafe or dangerous;
• Contain material that promotes any particular political agenda or message;
• Contain material that is unlawful, in violation of or contrary to the laws or regulations in California or wherever it was created;
• Contain any materials relating to lotteries, gambling, tobacco, alcohol, drugs, firearms/weapons, or any activities that may appear unsafe or dangerous;
• Contain material that defames, libels, misrepresents, or is negative about Sponsor or its products, or other people, products, or companies;
• Contain trademarks, logos, or trade dress owned by others or advertise or promote any brand or product of any kind, without permission, or contain any personal identification, such as license plate numbers, personal names, email addresses, or street addresses;
• Contain copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies, or other media or musical “samples”) without permission;
• Contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, or otherwise constitute an invasion of privacy or publicity rights;
• Communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate;
• Constitute in itself, a violation of law.
Submissions are the views/opinions of the individual Entrant and do not reflect the views of Sponsor in any manner.
WHEN CREATING A SUBMISSION, ENTRANTS SHALL NOT: (A) PUT THEMSELVES, OR ANY OTHER PERSONS, IN DANGER OF ACTUAL BODILY INJURY OR DEATH, OR (B) VIOLATE ANY LAW. ANY SUBMISSION THAT, IN SPONSOR’S SOLE DISCRETION, VIOLATES EITHER PROHIBITION IN THE FOREGOING SENTENCE SHALL BE DISQUALIFIED.
4. SUBMISSIONS
The competition is open to original, unpublished work created by Entrant on or after August 1, 2023. Entries may be submitted pursuant to the following guidelines:
File specifications: Submissions should be in JPG or JPEG format. Files should have a long dimension of at least 2,000 pixels (roughly 7 inches), and be saved at a minimum of 300 dpi. A file generally should be at least 1MB for good printing results; the system will accept files up to 10MB.
Simple file names are best; spaces, slashes, or other odd characters may cause difficulties with the hosted contest site. File names must have the .jpg or .jpeg extension.
Creating the entry: Enter by filling out all fields and uploading your photo on this website. Entry is possible only through this website. Entry is not possible by post, courier service, email, or any other method of delivery.
Follow on-screen instructions carefully and note that there are five separate pages of information to complete (fields with an asterisk* are required). These pages are: Rules review; AAA membership number; your contact information; photo upload; and photo information. Use the “SAVE AND NEXT” buttons at the bottom of each page to progress through the pages.
On the “photo” page, use the “BROWSE” button to locate the photo you wish to enter. You may either drag and drop your photo or search your files for it. To save time, you might want to search for it before beginning the entry process.
Note that winning entries will eventually be published: If you submit a low-resolution photo, we will need a better version if it is selected as a winner.
On the “photo information” page, please include some added information about the photo. This will accompany winning entries, so we may seek additional input if you provide a bare-bones description.
You may return to your entry later by using the “SAVE” button and using the credentials you established when you first created your entry. The “SAVE” button does not submit your entry.
Submitting the entry: When you are satisfied with the information you have provided, click “SAVE AND FINALIZE” at the bottom of the photo information page to complete your entry.
Your entry is not complete and cannot be judged until you click the “SAVE AND FINALIZE” button. An on-screen message and a confirmation email will signify that your entry has been completed successfully.
The only way to edit the entry once it has been submitted is to contact the contest administrator. Use the “Questions?” link at the bottom of each entry page or send an email to WWPhotoContest@ace.aaa.com to make those requests.
All entries and related information, including Materials, become the property of Auto Club and will not be returned. Proof of sending information to Sponsor is not considered proof of delivery to or receipt by Sponsor of such entry. All entries will be used by Auto Club in accordance with its privacy policy, which can be found at ace.aaa.com/legal/privacy.html. Entrant should be aware that Auto Club may be collecting nonpublic, personally identifiable information about such Entrant in connection with the operation of the Contest, and each Entrant hereby agrees to permit Auto Club to use such information as described in Auto Club’s Privacy Policy.
NOTE: Entries made in any manner inconsistent with these Official Rules will be declared invalid and disqualified from this Contest. By submitting an entry, you thereby affirm that you have read and agree to these Official Rules.
5. JUDGING/WINNERS
Members of the Westways editorial and design staffs will judge the entries based on creativity, technical expertise, and aesthetic value. The decision of the judges is final. Judging will commence at 3333 Fairview Road, Costa Mesa, CA 92626-1698, during or after the week of May 18, 2025.
Only the winners will be notified via phone or email, and all winners will be notified by June 16, 2025. Winners will be required to sign and return an Affidavit of Eligibility, Publicity, Liability, and Grant of Rights (the “Prize Claim Documents”) to Auto Club. All Prize Claim Documents, without any alteration, must be received by us within 30 days of the date of delivery of notification to a potential winner or alternate winners will be selected; provided, that under no circumstances shall Sponsor be required to make more than three attempts to award a prize.
By entering this Contest and/or accepting a prize, you agree to allow Auto Club to use your name, voice, and image in connection with publication of your winning entry, and for promotional purposes (as described in Section 3 above) without review, notification, or approval.
6. PRIZES
Prizes will be distributed on or after October 15, 2025, for use during 2026. Some prizes require advance notification of up to 60 days ahead of use. Prize providers may impose blackout dates on their prizes. Full details are included within each individual prize description below.
First Prize (1): Four nights’ stay for two in a Tapa Collection room at Hilton Hawaiian Village Waikiki Beach Resort with $500 resort credit; round-trip Economy Class travel for two from Pleasant Holidays; one Island Photo Tour for two from Blue Hawaii Photo Tours; $400 credit toward a car rental from Hertz; one all-inclusive afternoon sandbar adventure tour for two from Kaneohe Bay Ocean Sports; one courtesy week pass from The Parking Spot; a $250 eGift Card from AAA Tickets; one dinner for two at Merriman’s Hawai‘i; $100 worth of gas cards from Aloha Petroleum; and a one-year Automobile Club of Southern California membership with Classic benefits. Honorable Mention (Between five and 10): Two admissions to SeaWorld San Diego; a $125 eGift Card from AAA Tickets; a one-year individual membership at The San Diego Museum of Art, including membership at the Museum of Photographic Arts (MOPA@SDMA); $50 credit at the Anaheim Packing District; and a one-year Automobile Club of Southern California membership with Classic benefits. Estimated retail value: $553 each.
Each prize winner’s travel companion must be 18 years of age or older, or if such travel companion is under the age of majority in his or her state of residence (a “minor”), the prize winner must be such minor’s parent or legal guardian, or travel with the written permission of such parent or legal guardian. The prize winner and his or her travel companion must travel together on the same itinerary and must possess all required travel documents, and comply with any applicable hotel check-in requirements, such as presentation of a valid credit card.
All airline tickets are subject to the vagaries of flight variation, work stoppages, and schedule or route changes.
The Estimated Retail Value for travel prizes may vary depending upon points of departure and destination and is an estimate made before the Contest begins. The prizewinner will not receive cash or any other form of compensation if actual travel costs are less than the estimate made in these Official Rules. The round-trip air transportation element for any travel prize begins and ends at the point of departure.
Room taxes and other hotel fees that are not included may be payable at the time of checkout by the winner/guest. A deposit or payment in advance, or presentation of a credit card by the prizewinner, may be required at the time of check-in at the hotel. Any hotel cancellations or changes to hotel reservations after confirmation must be made with the hotel directly, and the prize winner is solely responsible for any charges and/or fees arising from changes made directly with the hotel.
The prize restrictions/conditions stated herein are not all-inclusive and the prize described above may be subject to additional restrictions/conditions, which may be stated in the “Prize Claim Documents” and/or other travel documents.
All Hotel/Resort/Airfare prizes: Occupancy limits may apply. Subject to availability and blackouts.
All prizes involving alcohol: Age restrictions may apply.
Many travel destinations may still have COVID-19–related restrictions. Before making travel plans, check to see if hotels, attractions, airlines, cruise lines, tour operators, restaurants, and local authorities have issued health- and safety-related restrictions or entry requirements. Local tourism boards are good resources for updated information.
Taxes, if any, are the responsibility of the winners. Winners, as applicable, will be issued IRS Form 1099. Airfare and other transportation, baggage fees, taxes, fees, gratuities, and all other expenses not expressly specified herein are the responsibilities of the winners. No prize substitutions will be allowed except by Auto Club, if, in its sole and absolute discretion, it determines that a prize component is not reasonably available, in which case a prize of equal or greater value will be awarded. Prizes, including, but not limited to, hotel nights and airfare, are nontransferable, nonrefundable, not redeemable for cash, and may not be sold. Certain other restrictions may apply. Pleasant Holidays: Prize includes round-trip Economy Class travel for two to Daniel K. Inouye Honolulu International Airport (HNL) on an airline to be determined by Pleasant Holidays from Los Angeles International Airport (LAX). Upon request, Pleasant Holidays may, at its exclusive option and under no obligation, provide this service to and from another California airport that offers nonstop service to HNL. The award is non-transferable, nonrefundable, not redeemable for cash, and may not be sold. Travel is subject to availability and some restrictions and blackout dates (such as holidays and peak travel periods) may apply. No substitutions for any component of this award shall be permitted. Codeshares are not allowed. The recipient of this award is responsible for paying any applicable taxes and fees assessed by the airline such as, but not limited to, the September 11 security fee of $5.60 per one-way segment, checked-bag fees, and seat upgrades. Blue Hawaii Photo Tours: Tour for two includes transportation with pickup and return in Waikīkī. Up to six additional participants may join the tour for $100 each. Lunch is not included. At least two weeks' advance notice is required. Tripods are provided. Tour may be canceled and rescheduled during periods of heavy rain. Valid January 5, 2026, through December 31, 2026. Hertz: Prize includes $400 credit on a car rental anywhere in the United States. The balance, which could include taxes, fees, and optional add-ons such as insurance, GPS, gas packages, and car seats, is payable directly to Hertz at the time of rental. Certificate is surrendered upon booking; any unused balance will be forfeited. Winner must be at least 21 years of age and have a valid driver’s license and credit card in their name. Rentals are subject to availability, which may be limited during peak dates such as late December and around holidays. Thirty (30) days’ notice is required to book prize. Kaneohe Bay Ocean Sports: Prize includes two tickets for an all-inclusive afternoon Kaneohe Sandbar tour, including live music, snorkeling, sandbar volleyball, stand-up paddleboarding, and the use of a bumper tube and banana boat. The three-hour tour departs at 1 p.m. Tuesday through Saturday from the He‘eia Kea Boat Harbor and includes lunch. In case the tour is canceled due to bad weather, every attempt will be made to rebook on another date. Prize includes taxes and fees and is valid from January 1, 2026, through December 31, 2026. The Parking Spot: Pass is good for one week (seven days) of rooftop, self-park, or valet services at any The Parking Spot location, subject to availability. Car Care services are not included. AAA Tickets: Virtual gift cards can only be used by AAA members to purchase admission to theme parks, attractions, live entertainment, and movie tickets. Certificates and unused amounts expire one year from date of issue, approximately December 31, 2026 (exact date will be noted upon provision of the prize). Merriman’s–Home of Hawai‘i Regional Cuisine: Prize includes a $200 certificate valid at any of the four Merriman’s fine-dining restaurants in Hawai‘i, including the location in Honolulu. Certificate cannot be used toward special promotions to include Happy Hour or with additional coupons, vouchers, and gift certificates. Certificate includes all food and nonalcoholic beverages; winner is responsible for gratuity and any balance above $200. Certificate is not redeemable for cash, and change will not be provided for any unused portion. Blackout dates apply. Aloha Petroleum: Prize includes a $100 Aloha Petroleum Gift Card. Gift Card can be used for fuel at any Aloha-branded fueling station and at any Aloha-branded Aloha Island Mart convenience store on O‘ahu, Maui, and Hawai‘i Island, with the exception of the Airport Cardlock and Waimea Cardlock fuel stations. Automobile Club of Southern California: Prize includes a one-year membership with Classic Benefits. Winner may apply value of the membership prize toward renewal of the following year’s dues, pursuant to the following: If the Auto Club membership is set to expire prior to or close to the approximate prize distribution date of October 15, 2025, you are advised to pay your renewal on time; AAA is not responsible for providing member services and benefits if your membership expires before you receive your award. Your award of a one-year Auto Club membership with Classic benefits may be applied to your account as a credit, redeemable at the subsequent renewal. If your household carries AAA Plus or AAA Premier benefits, the award value of Classic benefits ($57 in 2025) will be applied to your bill for the year; in this case, you would need to pay the outstanding balance to maintain the Plus or Premier benefits, as well as any associate memberships. If the prizewinner is an associate member, the associate membership value ($35 in 2025) will be applied toward the renewal dues of his or her sponsoring primary membership holder.
SECOND PRIZE: SAN DIEGO COUNTY
The Seabird Ocean Resort & Spa: Prize includes three nights for two and daily breakfast for two at Piper. Prize includes tax, daily resort charge, and valet for one car and is subject to space availability and blackout dates, including, but not limited to, holiday periods. Prize does not include incidentals such as, but not limited to, additional services and gratuities. Prize must be used between January 1, 2026, and December 20, 2026. Prize will be awarded in the form of a certificate. Winner must present a valid photo identification card and original certificate, no exceptions. Pedego La Jolla: Prize includes a Pedego Electric Bike custom guided tour for two of La Jolla. Stops could include the world-renowned La Jolla coastline, the La Jolla Cove, Mount Soledad National Veterans Memorial with 360-degree views of the San Diego coastline and mountains, Mission Bay, and Pacific Beach; winner may customize the itinerary with the guide. Meals are not included but restaurant stops may be incorporated at the winner’s option and expense. If Entrant demonstrates that the costs of arbitration will be prohibitive as compared to the costs of litigation, Sponsor will pay as much of the administrative costs and arbitrator’s fees required for the arbitration as the arbitrator deems necessary to prevent the cost of the arbitration from being prohibitive. In the final award, the arbitrator may apportion the costs of arbitration and the compensation of the arbitrator among the parties in such amounts as the arbitrator deems appropriate.
Neither Entrant nor Sponsor may act as a class representative, nor participate as a member of a class of claimants, with respect to any Claim; arbitration can decide only Entrant’s and/or Sponsor’s, or a prize provider’s individual claims and the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated; provided, however, that if this sentence is declared invalid or unenforceable, either in whole or in part, the remaining sentences of Section 8 shall remain in full force and effect. The arbitrator shall not have the power to award special, consequential, incidental, exemplary, punitive, or other similar damages against Sponsor or any prize provider. Entrant and Sponsor also have the right to bring qualifying claims in small claims court. Notwithstanding anything contained herein to the contrary, Sponsor or any prize provider may seek to obtain injunctive relief against an Entrant for the breach or threatened breach of these Official Rules, without posting bond, in addition to any other remedies in law or equity, which may be available to Sponsor or prize provider, in any of the federal or state courts located in Orange County, California. Each Entrant consents to jurisdiction and venue in the federal or state courts located in Orange County, California, for the purposes set forth above and/or to confirm any award obtained by Sponsor or a prize provider in arbitration.
THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM, THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN AAA RULES, AND THE RIGHT TO CERTAIN REMEDIES AND FORMS OF RELIEF. OTHER RIGHTS THAT ENTRANT OR SPONSOR WOULD HAVE IN COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION. If any provision of this Section is found to be invalid or unenforceable, then that specific provision shall be of no force and effect and shall be severed, but the remainder of this Section will continue in full force and effect. No waiver of any provision of this Section of these Official Rules will be effective or enforceable unless recorded in a writing signed by the party waiving such a right or requirement. Such a waiver shall not waive or affect any other portion of these Official Rules. This Section of these Official Rules will survive the termination of your relationship with Sponsor.
